How I work: terms of business

This page explains how I work with every client. Each project also gets its own written terms and agreement covering the specifics.

The short version

  • You get a fixed price in writing before any work starts, for all work.
  • You pay 50% to start and 50% before your site goes live. I'm not VAT registered, so there's no VAT on top.
  • A website build includes 2 rounds of changes, and a branding or video job includes 3. After that, further changes are quoted in writing before I start.
  • You see a preview before launch. Nothing gets added that you didn't ask for.
  • Your domain is in your name from day one. Your site and its content are yours once it's paid for. So are your logo, finished video and their files. Your Google profile stays yours.
  • If you ever move on, you get everything within 10 working days.
  • Care+ is optional. Cancel with 30 days' notice. Hosting on its own also needs 30 days' notice.

The agreement for your project sets out the details, including liability.

1. Who these terms are between

Me, Luke Duff, a sole trader, and you, the client. My trading address is Luke Duff, 135 Atkinson Road, Sunderland SR6 9AX.

2. Price and paying

  • Before any work starts, I send you a fixed price in writing. It says what's included. This goes for every kind of work: websites, branding, automation, custom software, web apps and features.
  • You pay 50% to start and 50% before launch. Your site goes live once the second payment is made. On a video job, the second 50% is due before I send the final files.
  • I'm not VAT registered, so the price I quote is the total.
  • Nothing gets added that you didn't ask for. If you want something extra, I tell you the price in writing first.

3. Changes and preview

  • A website build includes 2 rounds of changes. A branding or video job includes 3.
  • Any change beyond that, or any change request on other work, is quoted in writing before I do it.
  • You see a preview of your site before it goes live.

4. Your agreement

Every project gets its own written terms and agreement. It covers the specifics of your job, such as scope, timings and liability. The agreement for your project sets out the details, including liability.

I hold professional indemnity insurance with £100,000 of cover.

5. What you own

  • Your domain is registered in your name from day one.
  • Your site and its content are yours once it's paid for.
  • Stock photos, fonts and paid plugins come with their own licences, which I set up for your site.
  • Your logo, finished video and their files are yours once they're paid for.
  • Your Google Business Profile stays yours. I'm added as a manager, never the owner.
  • On web apps, custom software and automation, payment accounts (like Stripe or SumUp) and Google and other accounts (like Analytics, Search Console or Xero) are set up in your name.

6. If you ever move on

If you ever move on, you get everything within 10 working days: your site's files and content (the words and photos) and a full backup, as long as your account is paid up.

7. Care+ (optional)

  • Care+ website maintenance is a monthly plan for looking after your site. It's optional. You never need it to get a site built.
  • You can cancel with 30 days' notice. Email or WhatsApp me.

8. Hosting

Hosting on its own is quoted, and so is moving your site to me. You or I can end it with 30 days' notice. Email or WhatsApp me.

9. Taking card deposits

I can add a card deposit button to your site (through Stripe or SumUp), for example if you take bookings and want a deposit. It's quoted as part of your project.

10. Cancelling

If you're hiring me for your business

The 14-day right to cancel is for consumers only. The law says a consumer is “an individual acting for purposes which are wholly or mainly outside that individual's trade, business, craft or profession”. So if you're a business, including a sole trader hiring me for your business, it doesn't apply. Your project agreement says what happens if you cancel.

If you're hiring me as a consumer (for personal use, not a business)

You have the right to cancel within 14 days of the day your agreement with me starts, without giving a reason. This applies when you and I agree it at a distance, like by email or WhatsApp, or away from my business premises.

To cancel, tell me clearly by email or WhatsApp. You can use the model cancellation form I send with your quote, but you don't have to.

I won't start work in those 14 days unless you ask me to. If you ask me to start and then cancel, you pay for the work done up to the point you tell me, in proportion to the whole job. If the work is all done, and you agreed when you asked me to start that you'd lose the right to cancel once it's done, you can't cancel.

Any refund goes back the same way you paid, within 14 days of you telling me.

Care+ works the same way when a consumer signs up.

11. The law that applies

These terms are governed by the law of England and Wales.

The courts of England and Wales deal with any dispute. If you're a consumer living in Scotland or Northern Ireland, nothing in these terms takes away your right to bring a claim in your own local courts.

12. The Google rating on this website

The live Google rating and review count on this website come from Google Maps. By using it, you agree to Google's Google Maps Additional Terms of Service and Terms of Service, and Google's Privacy Policy applies to it.
